Notices Issued on 23-10-2018 returnable in 3 weeks to union of India through joint secretary ministry of finance

Honble division bench of Rajasthan high court jodhpur consisting honble justice sangeet lodha and honble justice dinesh mehta issued notices on 23 10 2018 returnable in 3 weeks to union of india through joint secretary ministry of finance, national,new india, oriental and united india insurance company.

The notices were issued on the writ petition jointly filed by aam bima sevanivritt karamchari samiti through its president pratap chand jain and general insurance pensioners all india federation through its legal secretary anil bhandari wherein validity of clause 35 (c) and clause (3A) in Appendix IV of general insurance *employees) pension scheme 1995 was challenged which discriminate amongst pensioners. 

Mr bhandari argued that once pension scheme was applicable for employee who has retired or died on or  after 01 01 1986 then there was no nexus to give the date 01 08 1997,whereas it should be 01 01 1986,hence cut off date 01 08 1997 may kindly be declared ultra virus of the constitution of india and further respondents be directed to enhance minimum pension and also dearness relief @the rate not lesser than 0.23%.
