Description:

In these Rules & Regulations unless there be anything in the context repugnant or inconsistent there with :

  • The Association shall mean the General Insurance Pensioners Association (Western Zone).
  • The Governing Body shall mean the Governing Body of the Association as constiluted by these Rules & Regulations from time to time includeing the President, Vice-Presidents, Secretary and Treasurer.
  • The Act shall mean the trade uncion act 1926 as amended, modified or re-enacted thereof for the time being in force.
  • Office shall mean the Registered office of the Association wherever it may be located.
  • Objects shall mean the Aims and Objects of the Association.
  • Words, importing the singular number shall be deemed to include the plural and vice-versa and the words importing masculine gender shall include feminine gender and vice-versa.

Description:

The Area of operation of the General Insurance Pensioners Association (Western Zone) shall be the states of Maharashtra, Gujarat, Madhya Pradesh and Goa.

Description:

The financial year of the Association shall be from 1st January to 31st December.

Description:

  • A Pensioner, from any of the General Insurance establishment/undertakings transacting Genera Insurance, reinsurance Business or in any way connected to or allied with General Insurance Business and residing in the states of Maharashtra, Gujarat, Madhya Pradesh and Goa and subscribing to the aims and objects of the Association shall be eligible to membership of the Association.
  • All applications for membership shall be made to the General Secretary of the Association and shall be required to be approved by the Governing Body or the membership committee, if the Governing Body decides appoint one.
  • On approval of the member-ship the applicant will be. Required to pay the fees as described hereunder.
  • Entrance Fees Rs. 25/-
  • Life Membership Fees Rs. 1000/-

Description:

  • Life Members: All individual who are admitted by the Governing Body and who pay the entrance fees and life membership fees as may be prescribed shall be enrolled as life members. At present Life memebership is Rs.500/- with Rs. 50/- as entrance fee, total Rs.550/-
  • Honorary Members: Any person whose connection with the association is deemed to be useful may with the consent of such person, be elected as Honorary Member of the Association. Such member shall however neither be eligible to be a member of the Governing Body nor shall be entitled to vote in any meeting

Description:

  • The Association shall maintain a Register of Members containing the name, address, occupatiun and the dates of admission and cessation of membership. The register will be kept open for inspection of the members of the Association on requistion and all entries required to be made therein shall be entered within a period of fifteen days.
  • If a member changes his address he shall notify the new address to the Association which shall thereupon be entered in the Register and shall be deemed to be his for the purpose of tne Asscciation-

Description:

A member shall cease to be a member:

  • on his death or on tendering his resignation in writing to the Governing Body.
  • on his Becoming insane or insolvent.
  • on his conviction by a court of law of an offence in connection with the formation , promotion , management or conduct of the affairs of the Association or a body corporate or of any offence involving moral turpitude.

Description:

A member shall be ,after due inquiry expelled, removed , censured or suspended from the membership of the Association by a two-third majority of the Governing Body if the actions of such member is found by the Governing Body to be detrimental to the interests and/or in violation of the rules and regulations of the Association or if such member fails to or refuses to observe any rules or directions of the Governing Body. Provided that the Governing Body shall first serve on the member concerned a showcause notice showing the charge framed and ask him to submit his statement of defence within a month. On receipt of the explanation the Governing Body shall have the power to take a suitable action against the delinquent member after allowing him to defend his case. If no reply to the showcause is received within a month, the Governing Body may take an ex-parte decision. For any such act of expulsion or termination no such member shall be entitled to prefer any claim for compensation or damage even though proved in a subsequent date that such act of expulsion or termination was wrongful and/or unlawful.

B. RIGHTS AND OBLIGATIONS OF MEMBERS:
Every member has a right to

  • Elect and to be elected in any election of the Association .
  • Submit suggestions, for discussion ,to the Governing Body and Sub-Commi ttee on any matter relating to the Association.
  • Inspect the accounts and proceedings of the meetings of the Association on appointment with the General Secretary.

No member is eligible to stand as a candidate for election unless he has been a member on the Register for twelve mcnths as on the last day of the immediately preceeding year.

Description:

The Annual. General meeting shall he held not later than six months after the end of each financial year.

The Annual General Meeting shall:

  • receive the report of the Governing Body , the accounts of the Association and the Auditor's report for the year ended 31st March.
  • elect a new Governing Body every three years.
  • appoint an auditor or auditors and fix. his/their remuneration.
  • transact any other business which may be bought forward by any members with the permissionof the Chair.

Description:

  • An Annual General Meeting of the Association shall be called by the General Secretary on such date, time and place as may be determined by the Governing Body. Notice of the A.G.M. shall be given not less than fifteen days before the meeting.
  • At every A.G. M. 2/3rd of the members on the roll, as on the date of the meeting ,shall form the quorum. If at any A.G.M. the requisite quorum is not present within half an hour from the time fixed for commencement of the meeting , the meeting shall stand adjourned for half an hour thereafter and shall meet at the same place unless otherwise decided by the President. No Quorum shall be necessary for an adjourned meeting.
  • Every member shall have one vote at the A.G.H. ln the event of an equality of votes on any resolution , the person presiding at the meeting shall have a second or casting vote.
  • Any inadvertent ommission to give notice or non-receipt or late receipt of notice by any member shall not invalidate the proceedings of the meeting. Notice posted and pasted on the notice board shall constitute valid issue of notice.

Description:

  • The President or the General Secretary or in his absence one of the Joint Secretaries, in consultation of the Governing Body , may call a special/ extraordinary meeting whenever he thinks it necessary by giving not less than five days notice.
  • A special meeting shall also be called on receipt of a written requisition signed by half of the total strength of members within ten days of the receipt of such requisition.
  • The Quorum for such meeting shall be 2/3rd of the members on the roll, as on the date of the meeting. No Quorum shall be necessary for an adjourned meeting.

Description:

  • The managment and control of the Association shall be vested in a Governing Body of not less than twenty two members, which will be elected every three years by the members of the Association at the A.G.M. from amongst the members who are eligible to vote.
  • The Governing Body shall consist of a Chairman (1), President (1), working President (1) vice -Presidents (4) , General Secretary (1), Joint secretaries (4), Treasurer (1), Assistant Treasurer (1) and Committee members.
  • Casual vacancies arising in the Governing Body shall be filled by the President by co-option.
  • The Governing Body may co-opt four members (one each) from the state of Gujarat, Madhya Pradesh, Chattisgadh & Goa.

Description:

  • The tenure of the Governing Body of the Association shall be of three years.The retiring off ice bearers and members of the Governing Body would be eligible for reelection.No office bearer however shall be entitled to hold the same office for more than two successive terms of three years each.
  • After every three years the Governing Body members shall be elected at the A.G.M. and the mode of election shall be by raising of hands or by secret ballot at the discretion of the Chairman of the meeting.

Description:

PRESIDENT AND VICE-PRESIDENTS

  1.  The President shall exercise such powers for the conduct of business/functions as may be vested in him by the Association from time to time.
  2. The President shall preside over all the meetings of the Association and the Governing Body, preserve order, sign all minutes and give a casting vote in case of equality of votes.
  3. The President shall have power , if and when necessary , to call emergency meetings of the Governing Bcdy or Extra-ordinary meetings of the Association.
  4. Any one of the Vice- Presidents ,duly authorised, shall carry out the responsibilities , duties and function's of the President in the absence of the President.

GENERAL SECRETARY

The General Secretary shall excercise all administrative powers as assigned to him under these rules and such of the powers as may be delegated to him by the Governing Body. Without prejudice to the generality of these provision the General Secretary shall:

  1. Convene all meetings to be summoned as aforesaid , maintain minute book and read the minutes of the previous meeting get them confirmed and signed by the President.
  2. make correspondence on behalf of the Association , make representations, arrange interviews and exercise supeivision over the affairs of the Association.
  3. Certrfy all bills and vouchers which are to be passed by the Governing Body for payment thereafter by the Treaserer.
  4. Maintain caused to be maintained an up -to-date register of members.
  5. Be responsible for submitting to the Registrar ofTrade Union or other Government Authorities reports, returns , applications etc., as may be required .
  6. Prepare a report on the working of the Association and after approval of the Governing Body place the same before the A.G.M. The Joint Secretaries shall generally help the General Secretary in his work and one of them shall perform the duties of the General Secretary in his absence.

TREASURER

  1. Shall be responsible for all the sums of money which may from time to tims be received by the Assor. iation. He shall issue receipts and make payments against bills, vouchers, demand notices of moneys payable by the Association under authorisation by competent Authorities, open bank accounts in a scheduled or nationalised bank and operate the same jointly with the General Secretary or Joint Secretary.
  2. Shall keep or cause to be kept regular accounts of income and expenditure and assets and liabilities of the Association and get the same audited and submit the same to the A.G.M. after getting the -same approved by the Governing Body.

Description:

  • The Governing Body shall meet atleast once in three months on such date, time and place as may be fixed by the General Secretary in consultation with the President or requisition by any five members of the Governing Body .
  • Five days notice snail be given to the members of such meeting. Provided that the President or the General may summon an emergency meeting to discuss matters of vital importance with 24 hours notice.
  • The Quorum for the Governing Body meeting shall be five. All decisions at the meeting of the Go erning Body shall be taken by a majority of members. If the requisite quorumis not present within half an hour from the time for cammencement of the meeting , the meeting shall. stand adjourned for a lat-er hour thereafter at the sameplace as may have been specified in the notice and the decision taken in such meeting shall be binding upon all the members of the Governing Body.
